Terms of Service

These Terms of Service ("Terms") govern your access to and use of widgetful, including widgetful.com, the embeddable widgets and forms, and related services (the "Service"), provided by Furvur Inc. ("Furvur Inc.", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

1. The Service

widgetful lets you create embeddable widgets and forms (such as feedback, polls, NPS, and contact forms), install them on your own websites with a snippet, and view the resulting responses in a dashboard. We may add, change, or remove features over time.

2. Eligibility and accounts

You must be at least 16 years old (or the age of majority where you live) to use the Service. You are responsible for activity under your account and for keeping your credentials secure. Notify us promptly at [email protected] of any unauthorized use.

3. Your data and content

You retain all rights to the data you submit and the responses and submissions you collect through your widgets and forms ("Your Data"). You grant us a limited, non-exclusive license to host, process, transmit, and display Your Data solely to provide, secure, and improve the Service. We do not sell Your Data.

4. Your responsibilities for end-user data

When you collect responses or submissions from your visitors, you are the party responsible (the "data controller") for that information. You agree to: (a) give your visitors any legally required notices and obtain any required consents; (b) maintain your own privacy policy; (c) only collect information you are permitted to collect; and (d) not use the Service to collect sensitive personal information (such as health, financial-account, or government-ID information) unless you have a lawful basis and appropriate safeguards. Our role in handling end-user data is described in our Privacy Policy.

5. Acceptable use

You agree not to use the Service to: violate any law or third-party right; send spam or unsolicited messages; transmit malware or attempt to disrupt or gain unauthorized access to the Service or its infrastructure; collect data deceptively; or exceed the rate limits or usage allowances of your plan. We enforce origin allowlists and rate limits at the edge and may suspend abusive widgets or accounts.

6. Plans, fees, and billing

Some features are offered free of charge; others require a paid plan. Paid plans, where offered, are billed in advance and are non-refundable except where required by law. We may change pricing on prospective notice. Free plans may display a "powered by widgetful" attribution, which paid plans may remove.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by Furvur Inc. and its licensors. These Terms grant you no rights in our intellectual property other than the limited right to use the Service.

8. Third-party services

The Service runs on third-party infrastructure (including Cloudflare for edge delivery and ingestion). Your use of the Service is also subject to those providers' terms, and we are not responsible for third-party services.

9. Availability; "as is"

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Furvur Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits. Our total liability arising out of or relating to the Service will not exceed the greater of CAD $100 or the amounts you paid us in the 12 months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Furvur Inc. from claims arising out of Your Data, your use of the Service, or your breach of these Terms or applicable law.

12. Term and termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or others. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in-app). Your continued use after the changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts located in Ontario will have exclusive jurisdiction, subject to any mandatory consumer-protection rights you may have where you live.
